Introduction

    A.What This Agreement Covers

UTB Bank of Ukraine: Are the world online leading banking platform in the centre of Eastern Europe. Ours headquarter base in Ukraine which accepts deposits, pays interest on pre-defined rates, clears checks, makes loans, and often acts as an intermediary in financial transactions. We also provides other financial services to its customers.

Credit reporting terms of service

This Agreement is between each owner of an eligible account, a person applying for an eligible account, or authorized representative appointed or entitled to online access on another person’s behalf (“you” or “your”) and UTB Bank. (UTB Bank of Ukraine). This Agreement governs your use of any online or mobile banking services maintained by UTB Bank of Ukraine and accessible throughUTBBANKOFUKRAINE.COM using a personal computer or a mobile device, including a smartphone, tablet, or any other eligible handheld or wearable communication device the “Service's”

Under the terms of this Agreement, you may use the Services to obtain financial products and services, access and view account information, and, for certain accounts, move money electronically and perform authorized transactions, for eligible Ukraine-based Bank consumer and small business accounts and affiliate accounts linked to the Service, such as those at utbukraine.org, utbbankofukraine.com, utbua.org, utbtg.org & Smith Incorporated ("UTBBANK").

When used in the Agreement, the term “small business” includes sole proprietors, non-consumer business entities, and individual owners of the business, unless the context indicates otherwise. If you are a small business customer, additional or different terms and conditions applicable to the Services, as well as additional Services available exclusively to small business customers, are included in the Business Services Addendum, which is a part of this Agreement.

When you first set up your Online/Mobile ID, we will link all of your eligible UTB Bank of UKRAINE and affiliate accounts, including joint accounts. If you open an additional eligible account at a later date, we will link your new account to the Service, unless you tell us not to do so. Unless indicated otherwise by the context, "linked UTB Bank accounts" or "linked accounts" refers to all of your accounts with utb Bank of UKRAINE and its affiliates that are linked to the Service.

When your Service is linked to one or more joint accounts, we may act on the verbal, written or electronic instructions of any authorized signer.

Please note that some of the Services may not be available when using certain digital devices or applications. For example, some functions may be available online through a personal computer but not available through our mobile app.

  1. The credit report is a file that reflects an individual’s credit history, including his/her debts and repayments, compliance with financial contracts and abidance by civil laws..
  2. The credit report collates and shows an individual’s up-to-date credit history in a comprehensive, accurate and objective manner. Hence, one’s credit record can also be regarded as his/her personal ‘financial ID’
  3. What is the role that the credit report plays in a bank’s credit granting decision? The bank uses the consumer credit report only as a form of reference as it makes a credit decision. The bank will typically also take a host of other factors into account as it decides whether to grant credit to a consumer.
  4. Internet Banking Services are the Bank’s services which provide access to account information, products and other services (including Transaction of financial and non-financial in nature) as advised by the Bank from time to time to the customers through the internet banking website of the Bank UTBBANKOFUKRAINE.COM .
  5. User refers to a customer of the Bank authorized to use Internet Banking Services.
  6. Confidential Information Refers to the information obtained by the customer through the Bank for availing various services through Online UTB BANK.
  7. Confidential InformationPersonal Information
  8. refers to the information about the User obtained by the Bank in connection with the Internet Banking Service.
  9. Account Refers to the User’s Savings and/or Current Account and/or Fixed Deposit or any other type of account so designated by the Bank to be eligible account(s) for the operations through the use of Internet Banking or Demat account opened with UTB BANK OF UKRAINE.
  10. “Password” is a secret series of characters comprising of letters of English alphabet and/or numeric numbers and/or special characters, that enables a computer User to access a computer network, file, data or programme.
  11. "Personal information" refers to the information provided by the Customer/User to the Bank.
  12. "SMS Banking" shall mean the Bank's SMS banking facility under UTBBankConnect (Core Banking) Services which provides the Customer services such as information relating to Account(s) of the Customer, details about transactions, utility payment, funds transfer and such other services as may be provided on the Customer's Mobile Telephone using ‘Short Messaging Service’ (SMS) by the Bank from time to time.
  13. Other Holders of Demat Account Refers to such holders other than the first named holder of the Demat Account. The Internet Banking Services of the Bank for Demat Account is available to a customer who has a Demat Account and Bank Account in his name (i.e. the first holder of the Demat Account and the Bank Account to be same). The Bank reserves its rights to consider any deviation to the above at its sole discretion. The Demat Account will be attached to the UserID and will be accessible through Online UTB BANK. Wherever the Demat Account is jointly held by the Customer, the Bank will construe that the other holders of the Demat Account have authorized the first holder to either query on the account or initiate transaction on the account and it will be binding on them.

    The Bank makes no representation and disclaims all express, implied and statutory warranties of any kind to the User and/or any third party including warranties as to accuracy, timelines, completeness, merchantability or fitness of the information for any particular purpose.

Data protection terms of service

These UTB BANK Data Protection Terms and Conditions are comprised of the following contractual clauses ('the Clauses') in order to adduce adequate safeguards with respect to the protection of privacy and fundamental rights and freedoms of individuals for the transfer by the data exporter to the data importer of the personal data specified in the applicable UTB BANK Data Security Addendum (the ‘Addendum’) entered into between UTB BANK and the counterparty to the Addendum (Bank and such counterparty collectively, the ‘parties’):.

Personal data we collect

'Personal data', 'special categories of data', 'process/processing', 'controller', 'processor', 'data subject' and 'supervi­sory authority shall have the same meaning as in Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data ('hereinafter the Directive');.

We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). Security information

Information Security refers to the processes and methodologies which are designed and implemented to protect print, electronic, or any other form of confidential, private and sensitive information or data from unauthorized access, use, misuse, disclosure, destruction, modification, or disruption.

Accepting the Agreement

When you apply for, enroll in, activate, download or use any of the Services described in this Agreement or authorize others to do so on your behalf, you are contracting for all Services described in the Agreement and agree to be bound by the terms and conditions of the entire Agreement, as well as any terms and instructions that appear on a screen when enrolling in, activating or accessing the Services.
